Hello
I dont have access to the certified labor copy , I am just wondering if we need it for AC21 purposes. I am not sure how to get it from my desi employer/ desi lawyer. I have a job offer with a fortune 200 company which is willing to do H1b transfer/extension so I am opting for H1b instead of EAD. I am pretty sure about the job description will satisfy the same/similar test.
Is the job title and job description mentioned on the labor cert? Mine is a pre perm case. Is it good to have copy of labor cert for AC21?

Ead renewal applied.paper filed at TSC.uscis received date is 07/03.my pd is eb3 jan 2007.EAD approved on 08/14. i still got for only 1 year and still lost one month on the ead.i am still using h1 and i waited for that 2 year ead announcement and i still got for 1 year.i filed 485 with old fees and now more money lost....i am so pissed off :mad:....is any one in the same boat...i do not know if any thing can be done at this point.....

My problem is simple.. do not misrepresent the facts, which is what seems to be the case here.. How can you have a H1 and not get paid??? Do you have any other logical reasoning? If the person has H1 and is not getting paid then there can only be two lawful situations: 1) person is on leave of absence, which is without pay or 2) has not yet started the job.
To answer your questions, yes my wife came here on H4 but she just did not approach a consultant for a job.. instead she went to school, got her degree, applied for jobs, gave interviews and finally got a job. BTW her company does not work with consultants, as it is not an IT company but a finance Big4. They used their own attorney to file for her H1. As luck could have, her application was not even considered as it did not come in the lottery draw. This happened twice.. Later we got our EAD and she started working with it. And yes, I know few more people who went through the same thing.. and all of them went to school in the US.

I find the second proposal very reasonable. If anyone is waiting for more than 5 years, then make that person exempt from country quota.
I'm not saying this because I've already waited five years. It makes sense to flush out oldest PD in the system. This would give people an idea about the wait time.
I'm fine even it is made to say, 6 or 7 years......We just need to know what to expect and how long to wait rather than being subjected to the whims and fancies of politicians and vagaries of the economic boom and bust!
Whether, it is 5,6 or 7 years can be debated but a reasonable time frame would really help.

Now; senators/congressmen who don't have much knowledge and you present to them why the country quota, etc., should be changed; will be given evidence through their research of what is going on with h-1b, labors in fast procesing states, etc., In this environment where there is sentiment against immigration it will fall on deaf ears and maybe even skew things in the future for you with the politicians because they are getting insight into this stuff at the wrong time.

IV could not even collect 20K in the Washington DC drive. I hardly saw EB3 folks contributing (based on my observation, I might be wrong so take it easy). If every EB3 person contributes 50USD, it will be enough to run a campaign. Action is the key, not posting in forums. Hope we get out of this EB2 vs EB3 and as focus on visa recapture.

Agreed that H-1B has a fixed date. But from the employer standpoint, you're their "full-time, permanent" employee on H-1B, right?

Employer sponsors GC so that employee that is temporarily employed on H-1B can become permanently employed on GC job.

If you want to play chess you got to play it by the rules. If you think you can win the game if we can change the rules, I would say it is not impossible but a long shot.
In USA every citizen is supposed to follow the law that is the fundamental reason why this place has been attracting so many immigrants ( anybody can pursue their dreams if they follow the law). If you think govt officials are above that you are wrong, if you encourage that by accepting it, that will not make this place any better than other third world democracies. All govt officials in the USA are accountable for what they are entrusted with, if you didn't know about it until now there is something wrong with the system we are working with. I can say this with full authority on this matter because I work for the goverment.
Let us give it a little though and see if fighting to make the dept follow the law is worth while. If we think it is not, getting a GC and living here is not any better than living back home.

I dont believe in flower/food/sos campaigns to resolve this problem...just because it worked once before doesnt mean it is going to work again..have we pursued a class action lawsuit against Department of State/Labor/USCIS for unlawful discrimination based on the country of birth in Employment Based Visas. Any idea if IV core ever took up this path? Can we attempt to do this? What are the costs involved and can we get some good lawyer representation to this goal?

Lawyers can quickly examine (for some hourly fee) and determine if indeed these Country Caps are a violation of US discrimination laws. If Lawyer says we got a point to argue then we can ask the lawyer what the costs are going to be to bring the lawsuit. Thats part 2 and thats a different story. If it's going to cost something like a 100,000 dollars, we can try to raise the money somehow. or maybe we can make it part of the law suit that if we win the case, the losing party will pay the legal fees. we need to talk to lawyers first about this issue and we can do it individually.
