    Why is everyone jumping on Dard-E-Disco?

    Come on guys chill.

    I have responded on this thread several times yesterday and reading through Dard-E-Disco's and everyone's comments, he's got a very valid point.

    We can't just poke around an established government agency because we feel they are not doing their job properly. I am sure they are doing their job based on policies, and their policies may seem not to favor everyone.

    They don't just make decisions on their own.

    The structure inside USCIS could be very complex. And just like any government agency, you just cannot change things anytime.

    Unfortunately, it could be affecting our lives but by voicing our concerns through proper venues like the IV forums is the way to go.

    We can shout, we can scream, and join protest and forums, but that's all we can really do.

    This is their country and we are guest here, and we have to respect whatever policies or laws they have because they gave us the opportunity to work and live here, and hopefully a chance to become permanent residents of this country, and in the futre become citizens.

    For me, I have to thank them for this opportunity, although at times it is very frustrating.

    Bodran, pl file your I-140 and your & sons I-485 immediatly..I am sure your I-140 will NOT take 2 years (as you are in EB3 ROW) to approve by which your son will be protected before he turns to be 21.

    So, hurry up & file I-140/I485 ASAP and your son will be safe under CSPA (Child Status Protection Act). Also, pl read CSPA rule..I remember it was published on Feb 14, 2003...pl check..

    I want to know if my 19 year old son can be affected by aging out.
    I have just received ALC certification and will now file I140 and I485 concurrently as my priority date NOV 22 2004 EB3 Rest of World will be current in June.
    Can someone who understands the aging out rules tell me if my son may have a problem?

    My interpretation of:

    40 (2) PENDING AND APPROVED PETITIONS AND APPLICATIONS.�Petitions
    41 for an employment-based visa filed for classification under
    42 section 203(b)(1), (2), or (3) of the Immigration and Nationality
    43 Act (as such provisions existed prior to the enactment of this
    44 section) that were filed prior to the date of the introduction of
    265
    1 the and [I]were pending or approved at the
    2 time of the effective date of this section, shall be treated as if
    3 such provision remained effective and an approved petition may
    4 serve as the basis for issuance of an immigrant visa. Aliens with
    5 applications for a labor certification pursuant to section
    6 212(a)(5)(A) of the Immigration and Nationality Act shall
    7 preserve the immigrant visa priority date accorded by the date
    8 of filing of such labor certification application.

    IMHO, the terms "pending" and "approved" are applicable only to I-140's filed before the date of introduction [May 15th 2007]. This is because there is no comma between the two terms "pending, or approved". This leads to only two scenarios:
    1. I-140 applied before May 15th 2007, but is still pending as of the effective date [which could be Oct 1st 2008].
    2. I-140 applied before May 15th 2007, and is approved as of the effective date [which could be Oct 1st 2008].

    Only the two scenarios above are eligible to continue/file under the old system.

    Yes, and you caught the last minute key just because you like to hear that. You just ignored what he said repeatedly for the last 30 mins.. I know Green Card has become very important for certain folks..

    But do the people has gone so low like you who are ready to do or hear anything for GC.. Oh man i can just imagin what kind of extent people can goto.


    I don't think there are contradictions. I have read his Businessweek articles. He is researching ways for America to remain competetive and believes that skilled immigrants who get permanent residence are the key.

    Dear Knnmbd,

    It seems to me you do not understand the difference between taxes and Social Security / Medicare.

    With my taxes I pay for (example) roads, police, courts, public TV and so on. And I use what I pay for (another nice example is when the police paid by me catches me with high speed and fines me :-)

    SS and Medicare are future services which I would not use while I am on H1/L1 or if I do not get permanent residence by some reason. This is my money which the US government has compulsory taken from me and I have not used it. So, I have the right to get this money back and use it for my eventual retirement in another country.

    We do not change the law of the land to benefit us, we just do not want to be cheated and treated like retarded.

    The real ridiculous stuff is the way the government agencies are treating the legal immigrants but nobody in the "great" country care to notice that, especially the law-makers.

    I believe that for Schedule A Professionals like nurses and PTs, the only solution is the bridge amendment to make it faster. They are now using EB3, which means competing against hundreds of thousands of Engineers. With the latest bulletin, it seems the wait is five to six years...wow! that was long! But I think that is not the true picture. By mid of the 2008 fiscal year, we will see the real picture so hang on. The wait could be in reality 3 years.

    Please do not make false statements. You are trying to paint everyone with the same brush.

    I had a Masters at the time EB3 was filed in 2002....from a top US school. The employer was okay with any category. The lawyer messed up...said that all categories were current and he knows best.

    This might be true in your case but not with every body else

    g 28 does produce soft LUds so it is normal.

    Guys/Gals - Those of you who are planning to file your 140 and/or 485 and are worried about the future consequences, please stop worrying about the bill and first of all get your 140 and/or 485 filed.

    Now, when you are done with it , please help IV to ensure that the current bill has enough amendments to make our future secure.

    If you are one of those who can keep working on your 140/485 , worry about the bill and help IV all together in a balanced way, no need to follow the step by step process :-)

    Things happen - they can always happen - they can be good - they can be bad - but Life Goes On.... so you do what you need to do for your current processing and whatever plans you have for future but just be aware that things can always change. Say you dont file your 140 assuming the world's gonna end and then before the world ends, 140 premium processing is stopped - ( not that there are any rumours regarding this ).... so get the point - carry on with your processes assuming the best out of this bill and help IV as much as you can.

    I just Spoke to sentor Specter office: 202-224-4254. They were very supportive. I spoke about the revised Visa bulltien and the effect of losing nurses. They were very sympathatic . I added i know how the sentor support immigration.
